Rep. Barry Moore Opposes House Resolution to Pressure VP into Invoking the 25th Amendment

January 14, 2021

‘I believe H.Res. 21 is a profoundly misguided power grab that will only exacerbate divisiveness across our country.’

Washington, D.C.—Today, Rep. Barry Moore (AL-02) issued the following statement regarding Democrats’ efforts to pressure Vice President Pence into invoking the 25th Amendment:

“With just a few days left in President Trump’s term, I believe H.Res. 21 is a profoundly misguided power grab that will only exacerbate divisiveness across our country. Our Constitution clearly states the power to invoke the 25th Amendment lies with the Vice President and the Cabinet, not Congress. This resolution is nothing more than a thinly veiled attempt to pressure the Vice President into taking actions he does not believe are necessary and perpetuates partisan theatrics, which is why I cannot support this resolution.”

Background: On January 11, Rep. Jamie Raskin (D-MD) introduced H.Res. 21, which calls on Vice President Pence to invoke the 25th Amendment of the U.S. Constitution. This action would declare the President “incapable of executing the duties of his office” and would install the Vice President as Acting President. After failing to pass by Unanimous Consent, this resolution was placed on the House Calendar, with consideration scheduled for Tuesday, January 12th.
